If you have had your driving privileges revoked, you could eligible to have your driving privileges restored. However, you need to be able to meet certain requirements. You can file a petition to have them restored and then the court will hold a hearing. The court will consider:

• The nature of the offense for which driving privileges were revoked.
• The degree of violence involved in the offense.
• Other criminal and relevant noncriminal behavior of the petitioner both before and after the conviction that resulted in the revocation.
• The recommendation of the person’s parole officer, which shall be based in part on a psychological evaluation ordered by the court to determine whether the person is presently a threat to the safety of the public.
• Any other relevant factors.

The court will evaluate those factors and determine:

• if you are rehabilitated;
• whether or not you pose a threat to the safety of the public; and
• If you have completed treatment required by the court.

If you are considering a petition to restore your driving privileges, you need to make sure you are filing the petition at the right time in your life. The judge will be able to consider a lot of factors about how you have conducted yourself while your driving privileges were revoked.
